Terms of Service
1. Acceptance of Terms
By accessing or using the Ecocollects platform, including our mobile application and website (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
2. The Service
Ecocollects is a technology platform that connects users who need waste collection with independent waste collectors (“Drivers”). Ecocollects is not a waste collection company and does not itself provide collection services. We facilitate scheduling, matching, tracking, communication, and payment between users and Drivers.
3. Eligibility & Accounts
You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it up to date.
4. User Responsibilities & Waste Classification
Users must accurately categorise and describe their waste, including weight estimates. Hazardous, medical, or otherwise regulated waste must be properly identified and may be refused or require special handling. Ecocollects is not liable for loss, damage, delay, or additional charges arising from misclassification, inaccurate information, or waste that a Driver refuses or is unable to collect.
5. Drivers: Independent Contractors
Drivers are independent contractors and are not employees, agents, partners, or joint venturers of Ecocollects. Ecocollects does not control the manner or means by which Drivers perform collections. Drivers are solely responsible for their own conduct, licences, permits, insurance, taxes, and compliance with waste-handling, environmental, and traffic regulations. Ecocollects disclaims all liability for the acts or omissions of Drivers.
6. Payments, Wallet & Fees
All payments are processed through Paystack. Users must maintain sufficient wallet balance to schedule pay-as-you-go pickups. The platform retains a 20% service fee on completed pickups and subscriptions; Drivers receive 80%. Drivers pay a fee to run promotions (advertisements). All fees are non-refundable except as expressly stated in these Terms.
7. Subscriptions & Promotions
Drivers may set their own subscription plans and pricing, which are billed monthly and may auto-renew until cancelled. Promotions (ads) are prepaid and remain live for the stated duration. Cancellation and renewal terms are described in the Service.
8. Cancellation & Refunds
Users may cancel a pickup before a Driver has been dispatched. Late cancellations may incur a fee. Refunds, if any, are credited to your wallet in our sole discretion and are subject to review. Payment chargebacks and disputes may result in account suspension.
9. Prohibited Conduct
You agree not to: use the Service for any unlawful purpose; misrepresent waste or account information; harass, threaten, or endanger Drivers or other users; defraud or attempt to defraud the payment system; interfere with or reverse-engineer the Service; or violate any applicable law or regulation.
10. Intellectual Property
The Service and all its content, including software, design, trademarks, logos, text, and graphics, are owned by Ecocollects or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal use. No other rights are granted.
11. User Content
You retain ownership of content you submit, but you grant Ecocollects a worldwide, royalty-free licence to use, store, and display that content to operate and improve the Service. You are solely responsible for the content you submit and represent that you have all necessary rights to do so.
12. Location & Tracking
The Service uses location data for matching and tracking. By using the Service, you consent to the collection and use of location data as described in our Privacy Policy.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECOLLECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM OR ₦100,000. ECOLLECT IS NOT LIABLE FOR THE ACTS OR OMISSIONS OF DRIVERS OR THIRD-PARTY SERVICE PROVIDERS.
15. Indemnification
You agree to indemnify, defend, and hold harmless Ecocollects and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of your use of the Service, your breach of these Terms, or your violation of any law or the rights of a third party.
16. Third-Party Services
The Service integrates third-party services, including Paystack for payments and mapping services. Your use of such services is subject to their respective terms. We are not responsible for the availability, accuracy, or acts of third-party services.
17. Account Suspension & Termination
We may suspend or terminate your account, or restrict your access to the Service, at any time, with or without notice, if you breach these Terms or if we reasonably believe your conduct harms Ecocollects, other users, or third parties.
18. Changes to These Terms
We may modify these Terms at any time. We will post updated Terms on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
19. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If unresolved, the dispute shall be settled by binding arbitration in Lagos, Nigeria, in accordance with the Arbitration and Conciliation Act (Cap. A18, Laws of the Federation of Nigeria). Each party shall bear its own costs.
20. Severability & Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ecocollects regarding the Service.
